Netflix to pay $7 million in privacy class action lawsuit

A US court has approved a preliminary settlement that stipulates that Netflix must pay $9 million (7.3 million euros) in a class-action lawsuit accusing the video-sharing company of violating consumer privacy laws.

U.S. District Judge Edward Davila in San Jose, California, said the February settlement compares “favorably” to other recent consumer privacy cases, including those involving Google and Facebook.

The judge also certified that the number of current and former Netflix subscribers nationwide is around 10 million, according to the order issued Thursday.


The subscribers accused Netflix of violating the Video Privacy Protection Act of 1988 by keeping records of the videos and Internet they had watched for at least two years after they canceled the service, as well as their credit card numbers.

They said Netflix used the data for marketing and advertising without their consent, violating a legal requirement that it purge “personally identifiable information” a year after it is no longer needed for the purpose for which it was collected.

Most people would be “extremely bc data indonesia uncomfortable” if the California company could keep their browsing histories and credit card numbers for longer, the indictment said.

The settlement calls for Netflix to “unlink” user histories from other data once a year has passed since the service was terminated. The money will be used to educate consumers and regulators on privacy protection.

The lawsuit was filed by former Netflix subscribers and Virginia residents Jeff Milans and Peter Comstock. The final judgment hearing will be held on December 5.
